A man was hospitalized after being shot by a U.S. Immigration and Customs Enforcement agent in New York City’s Marble Hill neighborhood on Thursday, according to the Department of Homeland Security and New York City officials.

The shooting occurred at about 4 p.m. local time near West 225th Street and Marble Hill Avenue.

Officials said he was taken to a hospital with non-life-threatening injuries. 

The NYPD was not involved in the shooting, the department said. 

Video from the scene showed numerous law enforcement personnel present. A gray vehicle with a bullet hole in the windshield could be seen in the middle of the road.

Two law enforcement sources told CBS News that preliminary information indicated ICE agents were attempting to take someone into custody when another male, who was not the target of the arrest, was shot.

DHS, ICE’s parent agency, said in a statement that officers were conducting a targeted enforcement operation to arrest a man from the Dominican Republic who they allege was living in the United States illegally.  

In a press conference Thursday night, NYPD Commissioner Jessica Tisch said preliminary information indicates a 28-year-old man was inside a grey Honda at the time of the shooting with a 5-year-old boy. Tisch named the wounded man during the press conference, but the NYPD was unable to confirm the spelling, deferring it to DHS.

Tisch said NYPD cameras captured a vehicle backing into a parking spot in front of a fire hydrant. She says video shows one plainclothes federal law enforcement officer approaching the driver’s side window with his gun drawn and a second plainclothes officer approaching the vehicle by the driver’s side headlight. According Tisch, the vehicle then moves forward out of view of the camera.

An ICE officer discharged his weapon during the incident, injuring the man, DHS said.

Tisch said the NYPD cameras did not capture the shooting, but based on evidence collected at the scene, at least one ICE agent discharged seven rounds, striking the driver in the neck below his left ear.

“ICE officers immediately rendered aid,” DHS said. “The individual is alive and at a local hospital. The FBI and HSI are on the scene. The incident remains under investigation. More information will be shared as it becomes available.”

Tisch said NYPD officers who were in the area responded to the scene after hearing reports of shots fired.

“When they arrived, they encountered several men in various forms of attire, including some in construction-style vests, face masks and at least one carrying a long gun,” she said.

Tisch said the injured man was handcuffed and seated on the ground. According to Tisch, NYPD officers placed him into an NYPD vehicle, rendered aid and transported him to the hospital.

The child was not injured and is in the care of a family member, Tisch said.

Democratic Rep. Adriano Espaillat of New York told CBS News in an interview Thursday night that the 5-year-old child was the son of the victim. Espaillat told CBS News that he met with the 5-year-old boy and his mother at the hospital, where the victim received treatment.

Espaillat disclosed the victim was under guard from ICE agents outside his hospital room, and Espaillat was not allowed to see him.

Late Thursday, Mamdani said ICE “put the man in an unmarked vehicle and whisked him away.”

DHS alleged that the man had associations to the Trinitarios gang. Tisch said he has two prior arrests. In 2023, he was arrested on a robbery charge and later pleaded guilty to fourth-degree larceny. He was also arrested in 2025 on a charge of criminal sale of a controlled substance, a case that remains pending.

Mamdani said he spent two hours on the phone with President Trump and DHS Secretary Markwayne Mullin on Thursday night to negotiate for the release of the man ICE agents shot, but those negotiations were unsuccessful.

Federal agencies have taken over the investigation, Tisch said.

There have been at least 30 shootings involving DHS officers during the second Trump administration, according to a CBS News analysis, some of which have turned deadly.
